MISUSE OF THE PRINCIPLES OF THE SHARIAH

The common use today of concepts such as necessity, compulsion, lesser of two evils, public interest etc is proof that many Ulama are using these exceptions liberally and subjectively, i.e. according to their base desires.
The fact that the public are familiar with these concepts shows that they are being used to perpetrate all manner of Haraam, e.g. legitimising mortgages, encouragement to vote, rendering Covid vaccines permissible & justifying the closure of the Masajid etc. And there are many more examples. The Deen has become the handmaid of exceptions.
The disingenuousness of the Ulama-e-Soo is that they use these exceptions liberally without definition, context, or explanation, thus deceiving the public in to believing that virtually any hardship falls within the remit of one of these exceptions. In this manner, the heart and essence of Deen is eviscerated.
The reality is the public should not even be aware of these concepts because their use is usually, if not always, for situations of imminent death/serious injury where absolutely no other halal option is available.
If I’m not mistaken, it was Maulana Ashraf Ali Thanvi Rahmatullah Alayh that said that expedience needs to be crushed like spices. The finer the spices, the better the taste.
Isn’t it revealing that Taqwa is now an alien concept? Alien because if a Mufti will deliberately omit to define and contextualise necessity, compulsion etc, what chance is there he will tell the questioner what Taqwa entails?
On this note, I’ll share an incident of Taqwa so that the public can understand the gold standard, the top in class, the barometer, the elite.
Caesar told Abdullah bin Hudhafah Radiallahu Anhu to become Christian. If he did so he would be granted half the kingdom and Caesar’s daughter in marriage. Enticement to strip someone of Deen comes in the form of wealth, power and women. Abdullah bin Hudhafah Radiallahu Anhu rejected the offer. Caesar prepared boiling water to burn Abdullah Radiallahu Anhu’s companions to get him to renounce Islam.
Here the concept of necessity could have been legitimately invoked but Abdullah Radiallahu Anhu refused saying that life and death is in the Hands of Allah. A couple of companions were martyred as a result (boiled to death). Caesar informed him he was next.
Abdullah bin Hudahfah Radiallahu Anhu began crying. He confirmed to Caesar that he was not crying because of fear of death but because he had only one life to give in the Path of Allah. He said he wished he had lives equivalent to the hairs on his body so that he could give that many lives for the sake of Allah.
Caesar then imprisoned him depriving him of food and drink for days. Abdullah Radiallahu Anhu was then presented with pork and wine. He refused to eat the pork or drink the wine. Abdullah Radiallahu Anhu said that though Allah has permitted me to consume haraam due to necessity, I will not do so, because I will never allow a non-Muslim to gloat over the fact that he had forced a Muslim to consume haraam.
A true believer cannot help but be awestruck and brought to tears by this level of Imaan.
These are our role models – the Sahabah – not these shameless carrion, pap smear, face diaper (mask) legitimising Muftis who are devils in human form.
To revive this dead heart, the daily CPR that is necessary is Taleem pertaining to the Stories of Sahabah. Further, Allah Ta’ala states: “And each [story] We relate to you from the news of the messengers is that by which We make firm your heart. And there has come to you, in this, the truth and an instruction and a reminder for the believers.”
May Allah Ta’ala grant us taufeeq to emulate our pious predecessors.

The ulama-e-soo’ and their activities are Signs of the proximity of Qiyaamah. They manipulate the Deen for worldly and nafsaani objectives. As lamentable as these evil developments are, they are to be expected.
Ulama-e-soo’ are on the increase. The predictions of Rasulullah in this regard must materialize, and this is happening today all over the world. The Ilm of the Deen is acquired for the dunya. Allah Ta’ala and the Aakhirat are the furthest from the minds of those who have spent years in the pursuit of the knowledge of the Qur’aan and Hadith. The dunya is being acquired with the A’maal with which Allah Ta’ala has commanded us to seek His Pleasure and our abode in Jannat.
