JANAAZAH ZULM – HARAAM CALLOUS REFUSAL
A Brother from Tongaat laments:
Asalaamualaikum
At the Tongaat Masjid ghuslkhana there’s been a repeated issue with the Malawi community been turned away.
The last incident was this past Jumuah. A baby had passed away. The father was turned away. The reason given was that the paperwork wasn’t in order or incomplete.
He was further told if he buries at the Tongaat Qabrastan, the police will be informed and the body will be exhumed.
With that being said, a prominent Memon businessman passed away and the entire burial was done without paperwork. In fact, the paperwork is still outstanding for over a month now.
Can people be turned away on account of incomplete paperwork?
What is the best advice going forward?
The Malawi baby was eventually given ghusl at another Masjid and buried just outside Tongaat. (End of the Brother’s letter)
Those in charge of the Musjid ghusalkhana and qabrastaan have acquitted themselves most despicably. They are guilty of having rejected a Fardh-e-Kifaayah obligation. In having done so, the entire community has become sinful except those who had opposed this callous haraam act of zulm.
Regardless of the incomplete paperwork, the obligation of ghusl and dafan remained. They had absolutely no right of refusing to permit the ghusl of the baby. It was indeed pure shaitaaniyat and aggravated zulm to threaten the father with police action if the baby had to be buried in the Qabrustaan. Those who had made this evil threat, should repent and apologize to the parents of the baby. They are heartless and will be dealt accordingly by Allah Azza Wa Jal.
Do they not have any Imaan left?
Their excuse of the paperwork was a vile canard, and this is borne out by the provision of all burial facilities to the wealthy person. They must hang their heads in shame for their disgraceful act of callous and haraam discrimination. They are utterly bereft of Khauf (Fear) for Allah Ta’ala.
By virtue of the Fardh-e-Kifaayah violation committed by the trustees, it is incumbent for the Muslim community to take up issue with the fussaaq trustees.
