KHWAARIJ IN SOUTH AFRICA?
QUESTION
According to Maulana Fazlur Rahman, the ex-Hadith Ustaaz of Azaadville Darul Uloom, there are Khwaarij in South Africa, and according to the instruction in the Hadith they should be killed. Please comment. If what he said is correct, will it be permissible for Muslims to execute the command mentioned in the Hadith? His discourse on this Khwaarij issue is as follows:
(The Hadith was recited). “Listen, contrary to the norm of the Ulama, I will present something new to you, regarding the Khawaarij. Nabi Sallallahu Alayhi Wa Sallam prophesied that some people will emerge from the east, they will recite a lot of Quraan. Previously the Hadith came, they will read Namaaz and they will do Ibaadat. You will regard your Ibaadat to be trivial infront of them. But their condition will be such that they will fight Muslims and they will leave the idol worshippers. Yuqaati loona Ahlal Islam Wa Yada’oona Ahlal Awthaan.
“In whosoever’s time they emerge, he should kill them.
Their killer will be the most virtuous, and if a Muslim is killed by their strike, he is the most virtuous.
Their Mazhab was explained in Kitaabul Imaan, whoever commits a major sin is a Kaafir, killing him is permissible.
I will say something regarding this Hadith, that look at South Africa now, didn’t any Khawaarij emerge? Or is it that Hadhrat Ali Radhiyallhu Anhu, in his time when war took place, they were exterminated?
Generally people looking at Bukhari will understand that they were exterminated. However, a Hadith comes in Ibne Maajah, they will emerge more than 20 times. More than 20 times, and at the last time Dajjal will emerge.
Nowadays there is a lot of Takfeer of Muslims. I am warning you, I say to you, think! I am not passing a decision, did that time not come? Think! (End of the Maulana’s comments)

In his address to some final year students, he clearly states that there are Khwaarij in South Africa who are making Takfeer and who are in favour (like the Khawaari), of killing any Muslim in South Africa who commit a major sin.
Kindly comment if there are any such Ulama in the Country.
ANSWER AND COMMENT
The issue is serious. Its gravity could be gauged from the command to kill the Khwaarij. Besides it being a crime in this country to incite others to kill, it is also haraam to kill, even the Khwaarij in Darul Kufr.
According to the Shariah, only the Khalifah has this right. Hadhrat Ali (Radhiyallahu anhu) was the Khalifah, hence he was fully entitled by the Shariah to issue orders for the elimination of the Khwaarij. But for Muslims in a kuffaar country it is HARAAM to kill deviates and even Murtads.
The ex-Teacher had not applied his mind when he broached this subject. ISIS type of juhala may seize on his talk and cite it as permissibility and an exhortation to kill Muslims whom they believe are of the Khwaarij. Then the liability will descend on the head of the poor Molvi Sahib who had not applied his mind correctly when acquitting himself on this topic.
The summary of his talk to the students is:
- Some Ulama are making takfeer
- These Ulama are Khwaarij
- Killing these Khwaarij Ulama is an ibaadat of the highest merit.
While takfeer by the Ulama of Murtaddeen is valid and necessary even in Darul Kufr, killing these Ulama, even if they happen to be Khwaarij, is not permissible in Darul Kufr. It is not permissible, neither according to the Shariah, nor in terms of the law of the land.
The Molvi Sahib, by not applying his mind has opened himself for the criminal charge of inciting to kill. Furthermore, Takfeer is a valid injunction of the Shariah. The Qur’aan Majeed is replete with condemnation of the kuffaar. The Kutub of Fiqh elaborately explain the masaa-il pertaining to kufr and takfeer. To believe that than Aalim who makes takfeer or murtaddeen is a Khwaarji is evidence for the intellectual imbecility of the propounder of the misconception.
Our advice for the ex-Teacher is to carefully study Ikfaarul Mulhideen, the Kitaab which Hadhrat Maulana Anwar Kashmiri (Rahmatullah alayh) authored to expound the subject which has confused the ex-Ustaadh. The Kitaab elaborately discusses the subject of Takfeer and the imperative need for Takfeer.
