COMMENT OF THE MAJLIS
This longstanding obnoxious dispute can be easily resolved if the directors of Amaanat Investment Holdings cast aside emotion and apply their minds intelligently. Being obstinate and acting in glaring conflict with the Shariah as these directors are presently doing, will only exacerbate the dispute which can be resolved SIMPLY without resort to kuffaar courts.
The directors of AIH do believe that they are Muslims. If our understanding is correct, then it follows that they are obliged by their allegiance or assumed allegiance to Allah Ta’ala to endeavour to understand the direction and directive of the Shariah of Allah Ta’ala. The Qur’aan Majeed states:
“Then We have established you on a Shariah regarding all affairs. Therefore follow it (the Shariah) and do not follow the (false) desires of those who know not.”
The issue requires, setting aside satanic pride, meeting the members of the opposition (Amaanat Minorities), and settle the disinvestment demand in terms of the Shariah. This is an easy prescription. It does not require hundreds of thousands of rands which the parties to kuffaar legal action will be constrained to squander down the haraam drain.
The other issues of past malpractices perpetrated by some directors can then be overlooked and forgotten, and not made a public issue. The immediate need is to finalize the disinvestment demand of the partners who want to quit. In fact, according to the Shariah they are no longer partners. Despite this Shar’i fact, their assets are being misappropriated in a haraam manner. It is haraam and a sin of utmost gravity to utilize the funds and assets of people without their consent. AIH is currently guilty of such haraam conduct.
The major stumbling block we can understand in the way of resolving the issue is Takabbur (Pride). Shaitaan had refused to set aside his takabbur, hence he became everlastingly Ma’loon (Accursed). On the contrary, Hadhrat Aadam (Alayhis salaam) reacted with total and superb Tawaadhu’ (Humility) and he became elevated and Maqbool. Now the directors of AIH should decide whose path they will follow – the path of Iblees or of Hadhrat Aadam (Alayhis salaam).
