SAHUC MUST BE COMPELLED TO REFUND THE MILLIONS IT IS SITTING ON
SAHUC never was a trading company. From its very inception it was an entity formed to facilitate the smooth operation of the Hajj journey for Hujjaaj, but which obligation it did not fulfil assiduously and correctly. Almost everyone had always been disillusioned with the so-called ‘services’ of SAHUC.
Anyhow, all of that is now past tense. What is of current concern is the millions of rands of public funds which SAHUC is sitting on. It has hitherto made no cackling sounds regarding the refunding. The affected persons who had deposited money in SAHUC’s account have a Shar’i right and a legal right to demand restitution.
The funds in SAHUC’s possession are Amaanat in terms of the Shariah. It is Amaanat (Trust) being held on behalf of the owners of the monies. SAHUC’s stupid ‘non-refundable’ clause has no validity. It is haraam, and we are certain of its invalidity also in terms of kuffaar law which governs the legal existence of the SAHUC donkey entity. Therefore steps must be instituted to compel SAHUC to refund the money.
Form a Collective Group
- Affected Hujjaaj should form a united committee or representative group.
- A class action is far stronger than individual complaints, especially when large sums are involved.
Engage SAHUC Directly (First Step)
- Write a formal demand letter to SAHUC, asking for:
- A full audited statement of the R48 million.
- A clear refund process with timelines.
- Send this via registered mail and email to create a paper trail.
Escalate to Oversight and Regulatory Bodies
- Consumer Protection Act (CPA): Submit a complaint to the National Consumer Commission (NCC) since this involves services paid for but not rendered.
- Financial Regulatory Bodies: If SAHUC collected funds in a manner resembling deposits, the Financial Sector Conduct Authority (FSCA) could be approached.
- Department of International Relations and Cooperation (DIRCO): Since Hajj involves international travel and agreements, DIRCO may intervene.
Legal Action
- Consult an attorney (preferably one specializing in consumer rights or class actions).
- Possible legal remedies:
- Class Action Lawsuit: A group of Hujjaaj sues SAHUC collectively.
- High Court Application: Seek a court order compelling SAHUC to disclose its financials and refund money.
This entity should not be allowed to swallow and digest the Amaanat of the millions it has extorted from the Hujjaaj.
