CLARIFICATION AND QUESTIONS
Q. In an earlier article The Majlis had explained and exposed bogus Qur’baani operators who claim to do Qur’baani cheaply in India. I know of an honest person who does Qur’baani in India also cheaply. But I have no doubt regarding his integrity and honesty. Some people have understood from the article of The Majlis that every Qur’baani vendor who does Qur’baani in India at the cheap price is bogus. Please clarify if this is the purport of your article?
A. No, it is not our claim that all Qur’baani vendors who operate in India are bogus. We had mentioned one specific person. Do again read our article. If you are confident of the bonafides of the Qur’baani vendor, then by all means have your Qur’baani done via him.
Q. The Majlis had mentioned Moulana Shaheen Ismail as a bogus Qur’baani operator. In the same article you had mentioned Moulana Omar Desai. I have placed my Qur’baani order by him. What is your opinion regarding him?
A. Maulana Omar is also doing some of our Qur’baanis. You need have no doubts regarding his Qur’baani operation. Furthermore, we shall have our own supervisors to ensure that the Qur’baani is discharged correctly.
Q. Is it possible to have a Qur’baani share for R300 in a cow as is being advertised by one Qur’baani vendor?
A. Yes, it is possible. The cows which are for Qur’baani over there are small in stature. Although small, they are valid for Qur’baani. The age of a cow has to be 2 years and more, and these cows of small stature are two years or older, hence the Qur’baani is valid.
Q. I have to make qadha of Qur’baani of a number of years. If I make Qur’baani of a cow, will it suffice for Qadha of 7 years?
A. No! Qadha Qur’baani has to be a full animal (goat/sheep) or its price. For qadha it is not necessary to slaughter an animal. The price of an animal may be given to the poor. Also, qadha Qur’baani may be made at any time during the year.
Q. Is one or two shares in a cow permissible for Aqeeqah?
A. Yes, it is permissible.
Q. When is Qur’baani Waajib?
A. If during the three days of Qur’baani (10th, 11th and 12th) one has the Zakaat Nisaab amount, then Qur’baani is Waajib. The current Zakaat Nisaab is R8,600. It is the price of 19.6 ounces/612 grams of silver.
Q. Is it permissible to give Qur’baani meat to non-Muslims?
A. Yes, it is permissible for Hanafis, not permissible for Shaafis.
Q. Is it correct that for Shaafis it is not Waajib for every person to make Qur’baani? The father can make Qur’baani of one animal on behalf of the whole family.
A. For Shaafis it is Sunnatul Muakkadah. Yes, one animal as mentioned by you will suffice for followers of the Shaafi Math-hab although it is advisable and meritorious that everyone makes his/her own Qur’baani.
Q. Some of our Qur’baanis are done in foreign countries. What is the status of our Qur’baani if Eid in the other country is one day before us? Will our Qur’baani be valid?
A. No, it will not be valid. Instructions should be given that our Qur’baani should be performed on the second day in such countries, that is on the 11th which will be the 10th for us.
Q. Many people have their Waajib Qur’baani done in other countries. When can they cut their nails and hair?
A. It is impossible to ascertain whose animal is cut at what time. One may cut the nails and hairs a couple of hours after Eid Salaat.
Q. People generally ignore the Sunnat method of distributing the Qur’baani meat. They store the meat in freezers for the greater part of the year. Is this correct?
A. No, it is not correct. It is improper to discard the masnoon method of distribution. The meat should preferably be divided into three portions – one portion for one’s own use, one for relatives/friends and one for the poor. It is miserly to store the meat for months.
Q. It is narrated that Hadhrat Abu Bakr (Radhiyallahu anhu) and Hadhrat Umar (Radhiyallahu anhu) did not make Qur’baani. What was the reason for this?
A. Both these senior Khulafa were paupers. Qur’baani was not Waajib on them. They could not afford it. Some Ulama also say that they had abstained for fear of it being understood that Qur’baani is Waajib. This is the Shaafi interpretation.
Q. Since when was Qur’baani ordained as a Sunnah?
A. In the sixth year of Hijrah.
Q. Many people are making Qur’baan of sheep without tails. Is this valid?
A. The Qur’baani of sheep without tails is not valid. All arguments presented to justify this haraam practice are baseless.
